Helping People Resolve Disputes Before They Become Litigation


Scott McKenna is the founder and mediator of Midwest Litigation & Mediation, LLC, a Kansas City–based mediation practice dedicated to helping individuals, families, landlords, tenants, businesses, and property owners resolve disputes through practical communication and voluntary agreements. Scott is a certified mediator, having completed his mediation training through the University of Missouri–Kansas City School of Law in 2017, and has built his practice around the belief that many disputes can be resolved more efficiently, economically, and respectfully through mediation rather than prolonged litigation.


Scott approaches every mediation as a neutral facilitator. His role is not to decide who is right or wrong, but to help participants identify the issues driving the conflict, improve communication, evaluate realistic options, and work toward solutions that meet the interests of everyone involved. Whether the dispute involves a landlord and tenant, family members, business partners, or parties involved in a civil disagreement, Scott believes the people closest to the dispute are often in the best position to craft a lasting resolution when given the right environment and guidance. 


Rent & Possession Mediation


Rent and possession matters are a cornerstone of Scott's practice. With more than 25 years of experience working with landlord-tenant issues, he understands that every eviction represents more than a legal filing—it represents a business problem, a financial problem, and often a personal crisis for everyone involved. Rather than immediately escalating every dispute into court, Scott encourages landlords, property managers, and tenants to explore whether mediation can resolve the matter before significant legal expenses, court costs, delays, and uncertainty occur. 


His experience includes standard nonpayment-of-rent cases, lease violations, holdover tenants, unlawful detainer actions, occupancy disputes, voluntary surrender agreements, payment arrangements, service coordination, post-judgment asset research, and investigations related to possession matters. This practical background allows him to understand both the legal process and the real-world challenges faced by property owners and tenants alike. 


Scott's philosophy is simple:


Mediation First. Litigation When Necessary.

When mediation successfully resolves a dispute, everyone benefits through reduced costs, faster resolution, and greater control over the outcome. When an agreement cannot be reached, the parties are better prepared to move forward with the appropriate legal process.

Family and Civil Mediation


In addition to landlord-tenant matters, Scott mediates a broad range of family and civil disputes. These include parenting and communication issues, property and financial disagreements, contract disputes, business conflicts, real estate matters, neighborhood disagreements, and other civil disputes where participants seek a confidential, structured, and voluntary process. 


Scott recognizes that many conflicts arise from misunderstandings, communication breakdowns, or differing expectations rather than legal issues alone. His mediation style emphasizes active listening, respectful dialogue, practical problem-solving, and helping participants identify solutions they may not have considered independently.


A Practical, Investigative Perspective


Scott's background provides a unique perspective that complements the mediation process. Throughout his career, he has developed expertise in organizing complex facts, reviewing documents, constructing timelines, interviewing individuals, assessing credibility, and identifying the issues that truly drive disputes. Those skills allow him to help participants move beyond positions and focus on practical solutions.


His experience also enables him to understand how unresolved conflicts often progress if left unchecked, allowing participants to make informed decisions based upon risk, cost, time, and practical outcomes rather than emotion alone. 


Military Service and Leadership


Scott is a proud veteran of the United States Air Force, where he served as a Security Police Specialist responsible for protecting some of the nation's most sensitive military assets, including Air Force One, the National Emergency Airborne Command Post (NEACP/Nightwatch), AWACS, Cobra Ball, and other high-priority resources. He also served on the Air Force's Emergency Services Team, a tactical response unit comparable to civilian SWAT teams. 


His military service instilled the professionalism, discipline, calm decision-making, and respect for people that continue to define his approach to mediation today.

Scott believes that successful mediation begins with listening.


Every participant deserves an opportunity to be heard, every dispute deserves careful preparation, and every agreement should be practical, voluntary, and durable. His goal is not simply to settle cases but to help people resolve conflict in a way that preserves relationships when possible, reduces unnecessary expense, and allows participants to move forward with confidence.


Whether assisting a landlord seeking possession of a property, parents working through family issues, business owners resolving contractual disputes, or individuals involved in civil conflicts, Scott remains committed to neutrality, professionalism, and helping participants reach informed decisions that work for their unique circumstances.
